Impossibility of Performance in Contracts for Engineering and Construction
The subject of impossibility of performance of contracts is examined a new from the point of view of exploring its applications to the field of engineering and construction. A review is first made of the old Anglo-American doctrine which held impossibility of performance not to be an excuse to the one who had made an absolute promise for engineering or construction work. Fact situations of all description which have thus been decided are then grouped so as to give the reader the basis of the limits of this doctrine.
