Perlindungan Hukum Kepada Pemegang Sertifikat Hak Atas Tanah: Studi Pada Kantor Pertanahan Kabupaten Wajo
Tujuan Penelitian menganalisis perlindungan hukum kepada pemegang sertifikat hak atas tanah di kabupaten wajo, dan faktor-faktor yang mempengaruhinya. Tipe penelitian ini adalah yuridis empiris, data yang diperoleh penulis dari studi dokumen maupun wawancara dengan pihak yang berkepentingan dalam hal ini pihak Kantor Badan Pertanahan Kabupaten Wajo, kemudian dilakukan analisis kuantitatif. Hasil Penelitian penulis mendapatkan bahwa Perlindungan hukum kepada pemegang sertifikat hak atas tanah di Kabupaten Wajo melalui Kantor Pertanahan Kabupaten Wajo dilaksanakan melalui pendaftaran tanah tidak berjalan secara efektif. Namun dalam hal ini pihak Kantor Pertanahan Kabupaten Wajo tidak serta merta melindungi pemegang sertifikat tetapi sebatas bentuk perlindungan terhadap administrasinya melalui pendaftaran tanah, yang mana dalam pendaftaran tanah tersebut terdapat prinsip-prinsip pemberian perlindungan dan kepastian hukum. Faktor yang mempengaruhi perlindungan hukum kepada pemegang sertifikat hak atas tanah di kabupaten wajo adalah Struktur, Substansi, dan Budaya Hukum. Ketiga faktor tersebut saling berhubungan terhadap pemberian perlindungan hukum kepada pemegang sertifikat hak atas tanah melalui pendaftaran tanah di kabupaten wajo. The research objective to analyze the legal protection for land rights certificate holders in Wajo Regency, and the factors that influence it. This type of research is empirical juridical, the data obtained by the author from document studies and interviews with interested parties in this case the Land Agency Office of Wajo Regency, then quantitative analysis is carried out. The results of the study the authors found that legal protection for land rights certificate holders in Wajo Regency through the Wajo Regency Land Office carried out through land registration did not run effectively. However, in this case the Land Office of Wajo Regency does not necessarily protect the certificate holder but is limited to a form of protection for its administration through land registration, in which the land registration contains the principles of providing legal protection and certainty. Factors that influence legal protection for land rights certificate holders in Wajo Regency are Structure, Substance, and Legal Culture. These three factors are interrelated to the provision of legal protection to land rights certificate holders through land registration in Wajo Regency.
