PENYELESAIAN SENGKETA ATAS KEPIMILIKAN ALAS HAK ATAS TANAH RANGKAP DENGAN OBJEK FISIK TANAH YANG SAMA STUDI PUTUSAN MAHKAMAH AGUNG NOMOR 2902 K/Pdt/2014
ABSTRACT The control and use of land must have a foundation of rights over the land, so that the control and use of the land is legal and has legal protection. Mastery of land can be defined as legal control and physical control. Juridical land tenure is control of land based on rights, which is protected by law and generally gives the right holder authority to physically control the land that is held. However, there is also juridical control which, although it gives the authority to control the land that is physically legally held, in reality the physical control is exercised by another party, for example if the land that is owned is leased to another party and the lessee physically controls the land. In the National Land Law there is also a juridical control which does not give the authority to physically control the land concerned, for example the creditor who holds the security right has juridical control over the land that is used as collateral, but the physical control remains with the owner of the land.
