Legal Problems of Water Utilities
An apparent socio‐legal policy of placing the burden upon public water utility agencies in negligence cases has been a growing concern of the water problems committee of the National Institute of Municipal Law Officers (NIMLO). This article discusses cases in Kansas, Michigan, and Washington, among others, where the courts have specifically invoked the doctrine of res ipsa loquitur to raise the inference of municipal responsibility for alleged injuries.
