Court Defines Feasibility for Wetlands Protection
The owner of a resort in northern Michigan sought to remain competitive by developing a golf course on property contiguous to the resort. Construction required that 3.69 acres of wetlands be filled. After many proceedings and hearings, the state Natural Resources Commission and a trial court approved the issues of a construction permit. The appellate court agreed that the owner proved that no “feasible and prudent alternatives” existed.
