Most building contracts contain a clause allowing the architect to instruct the exclusion from site of any person employed there, but either the contract will say that the architect should not act vexatiously or unreasonably or the general law will imply that. This chapter discusses two scenarios. The first concerns an architect who, after inspecting the building, refused to certify practical completion, leaving the contractor liable for substantial liquidated damages. In the second instance, the architect was following the site agent, who was following the client as they walked through the almost finished house. The real reason for coming to blows was that the contractor was very much delayed and facing substantial damages, but it did not have the ability to quickly finish the project so chose to abandon the Works. The client should not venture onto site unaccompanied but should notify the architect, who would accompany the client around the site.
