Burst Water Pipe is Evidence of Negligence
A water company had a duty to come forward to defend itself against an inference of negligence on its part for a burst water pipe, a Washington appellate court ruled. According to the court, the doctrine of res ipsa loquitur recognizes that an accident may be of such a nature that the occurrence itself is sufficient to establish prima facie the fact of negligence on the part of the defendant.
