Consumers, Corporations, and Associations
Many professionals seem to be hopelessly confused when dealing with clients or with parties to a building contract. Everyone knows about consumers in the sense that the word is bandied around frequently. The key thing to remember about consumers is that they are treated in a distinct way by the law, quite different from companies. There are Acts of Parliament dealing with consumers and their treatment with which every construction professional should be familiar. Essentially a consumer is not a corporation or commercial enterprise. A corporation is an artificial legal entity. If an architect receives a commission to carry out work from an association, such as civic societies, local history societies, etc., and it becomes necessary to take legal action to recover fees, the architect will no doubt take a solicitor’s advice. Nevertheless, it is useful to know who is legally responsible for any fees owing.
