Water Right Declared Abandoned
Cedar Point Oil Company operated an oil and gas well in Texas. The company began to discharge produced water, a mixture of groundwater and chemicals used during drilling, into Galveston Bay without a federal permit. The local Sierra Club filed a citizen suit under the citizen provision of the Clean Water Act (CWA) alleging that Cedar Point was violating the CWA by discharging into the bay without a permit. The trial court ruled for the Sierra Club and an appellate court upheld the decision.
