Tribal Water Quality Standards Binding
In 1987, the US Congress amended the Clean Water Act (CWA) to authorize the US Environmental Protection Agency to treat Indian tribes as states under certain circumstances for purposes of the CWA. Isleta Pueblo adopted water quality standards that were approved by the USEPA. These standards are more stringent than New Mexico's standards. Albuquerque challenged the approval. The trial and appellate court ruled for the USEPA.
