Penalties Upheld for SDWA Violations
Wilbar Realty owned and operated public water systems that used groundwater. In May 1991, the Pennsylvania Department of Environmental Resources (DER) penalized Wilbar $36,900 based on 14 alleged violations of the Safe Drinking Water Act, including operating a well without a permit, failing to provide a certified operator, failing to develop an emergency response plan, failing to submit monthly operational reports, and failing to notify the DER within an hour of knowing that some customers were getting inadequate water. Wilbar appealed to the Environmental Hearing Board (EHB), which reduced the penalty for the first violation by $1,850 but sustained the rest because there was a reasonable fit between the violation and the penalty. The EHB found, for example, that the first violation alone justified a penalty of $35,050. Thus, the EHB declined to individually evaluate the appropriateness of penalties imposed for other violations.
