Control district has authority over utilities
The Supreme Court of Florida ruled that the state Public Service Commission could not authorize a private utility to operate within an environmental control district without the district's consent. Legislation granting the PSC exclusive jurisdiction over each utility's authority and rates also created the control district and gave it authority over the construction of any water or sewer system within its boundaries. The supreme court agreed with the control district that the PSC lacked authority to extend the utility's service within district boundaries.
