Architects and clients really do need to be sure about agency or expensive mistakes can occur. People must get the principles clear. The relationship between architect and client is in some degree, but not in everything, that of agent and principal. The architect is the agent and the client is the principal. The architect and the client may get into an agency relationship in any of four ways: expressly, by implication, by necessity, and by ratification. The agent’s authority is important. It may be actual or apparent. An architect’s actual authority is set out in the conditions of engagement. The fact that the architect’s terms of engagement may require the architect to obtain the client’s authorisation before issuing any instructions does not concern the contractor even if the contractor knows that the architect has not asked the client first.
