Regulatory Commission Gains Managerial Influence
In 1990 Arizona's Corporate Commission proposed rules that would require utilities to file certain information with the commission and/or that would require the utility and its affiliates to maintain this information. The rules would also require public service corporations to obtain the commission's approval for certain transactions. The reporting regulation would require notice from any utility or affiliate proposing to organize or reorganize a public utility holding company to disclose information about the proposed company. The rules would require commission approval of the organization or reorganization of utility holding companies. The state attorney general refused to certify the proposed rules, asserting they were not within the commission's power to adopt. The commission challenged the attorney general's refusal.
