In 1989, two CSX Transportation freight trains were traveling on adjacent railroad tracks. Because of heavy rainfall and flooding, the tracks collapsed, and the trains derailed while passing each other. One car broke open and its contents, corn syrup, flowed into the nearby Youghiogheny River, killing 10,000 fish. A criminal complaint was filed against CSX for violation of the state Fish & Game Code, which made it a crime, regardless of intent, to allow any substance poisonous to fish to flow into any waters of the state. The trial court dismissed the charge, saying it was necessary to establish a voluntary act for a violation of the law.
