Recent Decisions on Utility Liability for Fire Protection
This article discusses two recent decisions by the Pennsylvania Supreme Court that overturned long‐honored legal precedents concerning water utility liability for fire losses. They well may have the effect, in Pennsylvania as well as in other states, of greatly increasing utility liability. These two cases raise serious questions of public policy concerning both municipally‐owned and investor‐owned water utilities.
