USEPA Must Require States to Identify All Pollution Sources
The US Environmental Protection Agency (USEPA) promulgated a final rule that provided that with regard to some, but not all, of the polluted waters listed pursuant to the Clean Water Act, the states must identify the factories and other “point sources” responsible for discharging toxic pollutants into those waters and must develop strategies to expedite control of pollution from those sources. The National Resources Defense Council challenged the rule, contending states had to identify all sources discharging any pollutant. The court agreed.
