The Supreme Court of Virginia ruled that a city can exercise its right to sell surplus water in an adjoining county without the county's authorization and consent, because the water main to which the city planned to connect the customer, laid in 1963, existed at the time the county water authority was created, in 1964. A trial court enjoined the city of Martinsville from providing water service to a warehouse located eight feet from the city main and 430 feet from the nearest county Authority water main. The appellate court reversed the trial court's decision, emphasizing the city's power to sell surplus water and its authority to vend such water to customers beyond the corporate limits.
