Pollution Control Feasible
The West Virginia Water Pollution Control Act requires any company wishing to open or abandon a mine that is expected to produce a water discharge to obtain a Water Pollution Control/National Pollutant Discharge Elimination Permit from the Department of Natural Resources. Omega Mining Company received a permit in 1983. Property owners around the mine opposed the permit and appealed to the Water Resources Board which upheld the permit. A trial court affirmed the decision. A further appeal to the state Supreme Court was also decided in favor of Omega.
