This case involved a water claim from a creek in Powell County, Montana. The water right was originally decreed for the purpose of placer mining to a mining company in 1913 with a claimed priority date of June 1, 1865. That right was transferred four times between 1939 and 1959. On July 6, 1959, Clifford E. Graveley received the water right with other water rights, placer claims, and ditch rights. In May 1985, he was granted a temporary preliminary decree of the water right. Objections were filed on the basis that the claim had been abandoned through nonuse. At a hearing, evidence was produced that the water right had not been used at all for at least 50 years prior to June 1, 1973. The Water Master held and the Water court affirmed that Graveley's claim should be terminated.
