Court requires depreciation adjustment
In 1977, Capital City Water Company (CCWC), which needed storage and a backup source of water, contracted with the Public Supply District No. 2 of Cole County (PSD2) to use all of PSD2's storage tanks and wells. In exchange, CCWC agreed to operate and maintain the tanks and wells, pay $2,000 per month to PSD2, and provide PSD2 with all its customers' water. In 1989, CCWC requested additional revenues of $516,477. The state Public Service Commission (PSC) reduced the request by $238,544 and on rehearing awarded no additional annual revenue. The trial court upheld the PSC. However, on appeal, the case was returned to the trial court for further proceedings.
