Water Service Area Not Exclusive
The Port of Seattle and King County Water District (KCWD) were duly constituted municipal corporations in King County. The port's boundaries were conterminous with the county's. The port provided water service to the international airport, which it owned and operated. The port began construction of several improvements on property it acquired at the airport; it proposed to provide water service by extending a water line to the property from the airport. The KCWD, which had adequate existing water lines in place to serve the port's acquired property, objected to the proposal. KCWD had included the property in its comprehensive water plan and had made major capital improvements there. KCWD sought an injunction against the port's proposal. The trial court ruled in favor of KCWD. The trial court decision was reversed on appeal.
