It is always prudent for them to enter into a formal written contract and the Codes of Conduct of both the RIBA and the ARB require the architect to do so. Up to the moment the employer and contractor enter into the contract, the architect has been acting for the employer as agent with limited authority. It is important that the architect understands what agency means.
