Most people have a vague idea about copyright and, for most people, a vague idea is probably good enough, but for anyone involved in the creation or the reproduction of information, whether drawings, 3D or text, it is important to have a better than vague idea. In the UK, the author of the copyright work in general has the right to be identified as the author, but the right must be claimed. It is called a ‘moral right’. If a moral right is infringed or if anyone is about to use the architect's material without consent, the architect can ask a court to order the infringement to cease. In an action for infringement of copyright, a court may have regard to the flagrancy of the infringement and any benefit gained by the person doing the infringement when considering whether to award additional damages taking everything into account.
