Decision Favors Insurers
Several parties owned a 20‐acre wood treatment facility in Arkansas. For nearly 20 years, lumber products were treated there with various chemicals and the waste was spread onto the ground for weed and dust control. The state investigated alleged environmental contamination and sought to permanently enjoin the owners from polluting the state waters and to remove and contain wastes. The federal government also filed an action in 1987 to require cleanup of the hazardous substances. Over the years, several insurers had issued comprehensive general liability policies that insured against damages because of property damages. The owners sought a declaration that the insurers had a duty to indemnify them for the state and federal actions and for the costs of cleanup. The trial court ruled for the insurers.
