Impact Fees Found Arbitrary
Tarpon Springs Arcade Limited owned a 1920s‐era building with 33,700 sq ft of recently remodeled interior space. It was served by a single water meter and sewer connection. In 1976, the year the city of Tarpon Springs had adopted an ordinance imposing impact fees on new or expanded water and sewer service, the building had a unit factor of not less than 35.2 for each service. The subsequent renovation did not significantly change water and sewer connections. In imposing an impact fee, a city official treated the structure square foot by square foot, not as a single structure. Arcade sued and the impact fee was refunded.
