Responsibilities of the Engineer and the Contractor under Fixed-Price Construction Contracts
The presentation is the combined efforts of all of the members of the Construction Committee of the United States Committee on Large Dams of the International Commission on Large Dams. Large dam construction to a very substantial degree is performed under fixed price contracts. The Engineer provides the technical know-how and he represents the Owner in the contractual and administrative functions during the execution of the work. The contracting industry is basically the source and reservoir of trained and knowledgeable construction personnel, and the provider of the plant, equipment, facilities and management for the actual construction. The purpose of this paper is to promote a better mutual understanding and appreciation of the positions, functions, and obligations of the various parties involved, and to accentuate those trouble spots that continue to occur in contractual relationship so that they can be overcome or avoided.
