TANGGUNG JAWAB NOTARIS/PEJABAT PEMBUAT AKTA TANAH DALAM PEMBUATAN PERJANJIAN JAMINAN KREDIT DAN COVER NOTE (STUDI PUTUSAN PENGADILAN NEGERI BANYUWANGI NOMOR 253/PDT.G/2020/PN BYW)
ABSTRACT Notary/Official Land Deed Maker (PPAT) has a role in a credit agreement and security agreement. The case raised in this study originated from a credit agreement between BTN and PT AW which was made before Notary/PPAT SK. As security for the loan, PT AW as the debtor provides security in the form of land. In relation to the administration of land certificates for the purpose of providing security, Notary/PPAT SK issued Cover Notes and therefore the credit is disbursed early to PT AW. However, Notary/PPAT SK did not carry out what he promised in the Cover Notes and the Land Mortgage on behalf of BTN was never established. Several certificates turned out to have been encumbered with Land Mortgage on behalf of other parties. Consequently, BTN was at a loss due to credit arrears and was unable to execute the previously agreed security. The main issues raised in this study are the responsibilities of Notary/PPAT in making Land Mortgage encumbrance agreement and its implementation in the Banyuwangi District Court Decision Number 253/Pdt.G/2020/PN Byw and the enforceability of the Cover Note made by Notary/PPAT in connection with security administration. This is normative juridical research. The type of data used is secondary data obtained through literature study. In the case of the Banyuwangi District Court Decision Number 253/Pdt.G/2020/PN Byw, Notary/PPAT SK did not inform the creditor about the appropriate form of security for land rights and the procedure for its encumbrance to the detriment of BTN. The Cover Notes issued by Notary/PPAT SK contained guarantees on matters that are not within the authority of Notary/PPAT to guarantee it. Keywords: Credit Agreement, Land Mortgage, Cover Note.
