Facilitation of construction project management through building contracts: A South African perspective on the locally developed suites of contracts
This article reviews the depth to which theSouth African suites of contracts may facilitatethe effective implementation of constructionproject management practices. The hypothesisstates that the standard South African formsof contract for building work have evolved topromote control through construction projectmanagement processes. The South Africansuites of contracts are reviewed against theproject management office’s (PMO) main focusareas for best practices. This endeavours toestablish the conduciveness to facilitate goodproject management functions on buildingprojects. The main clauses of each contractare compared to the construction projectmanagement knowledge areas. Two contractsare reviewed, and it is established that bothcontracts (General Conditions of Contract forConstruction Work 2015 and the Joint BuildingContracts Committee’s (JBCC) Principal Building Agreement Edition 6.2)provide the employer’s agent (EA) the necessary authority to manage theproject for its intended purpose. It became apparent that the contracts mayallow certain project management functions to be implemented by placingdifferent emphases on different aspects of the contract. Due to the complexityand uniqueness of each project, the number of standard contract conditionsgoverning a contract are limited. A strong project management function musttake place during the planning phases. The contract used influences the wayin which the project management functions are applied during the projectlife cycle (PLC). Thus, the project manager must have an intimate knowledgeof the content of the contract in order to implement the desired constructionproject management functions, as required during each of the PLC stages.
