La représentation de la nature par les collectivités territoriales devant le juge judiciaire à la lumière de l’article L.142-4 du Code de l’environnement
The article L. 142-4 of environmental code allows regional and local governments to seek civil compensation in a criminal case, in case of environmental infringement. In fact, the article was introduced while the process about Erika damage on french western coasts was occurring. Some of regional and local governments received compensation for ecological damage. Six years after, our contribution is about advantages and concerns of article L. 142-4 C. env. It shows the great opportunity to amplify the capacity to represent nature in front of the judge, especially beside environmental associations. The regional and local governments can go to court when they prove the existence of damage on their territory. This way to define the suffered damage occurs however confusions as by judges as by civil parts. At least, the problem of plurality compensation if many persons complain is still there.
