The invention relates to a hydraulic oil tank and an excavator and relates to the technical field of excavators. The hydraulic oil tank comprises a tank body, an oil suction filter element and an oilreturn filter element. The tank body is provided with an oil inlet and an oil discharge port, the tank body is provided with an inner cavity, the oil suction filter element and the oil return filter element are mounted in the inner cavity, and the oil return filter element is located above the oil suction filter element; the oil return filter element communicates to the oil inlet, and the oil suction filter element communicates to the oil discharge port, so that an oil liquid entering the inner cavity via the oil inlet passes through the oil return filter element and the oil suction filter element successively and flows out from the oil discharge port. The excavator comprises the hydraulic oil tank. The oil suction filter element and the oil return filter element in the hydraulic oil tankare distributed oppositely up and down, so that the needed dimension of the cross section of the hydraulic oil tank is reduced, and therefore, the volume of the hydraulic oil tank is reduced, the needed filling amount is reduced and the hydraulic oil tank is more oil-saving.
