The invention discloses a spillway structure crossing a gully and a construction method. The spillway structure crossing the gully comprises side walls, a bottom plate, side beams and a bottom beam, and the side walls, the bottom plate, the side beams and the bottom beam form an upper spillway structure; a supporting bent frame is arranged under the upper spillway structure and is of a reinforcedconcrete structure; an enlarged base is arranged at the bottom of the supporting bent frame, and excavation parts around the base is backfilled with embedding stone concrete; a connecting beam is arranged on the upper part of the supporting bent frame, the supporting bent frame, the base and the connecting beam form an integral structure, a bottom beam of the upper spillway structure is located onthe connecting beam, and the bottom beam and the connecting beam are under the joint force. According to the spillway structure, the base, the supporting bent column and a beam structure are adoptedto support the upper spillway structure at a gully so as to prevent from reducing the spillway bottom plate elevation and gully backfilling treatment, the engineering amount of foundation treatment when the spillway passes through the gully can be greatly reduced, and original gully water discharge is not affected, and a special drainage channel is not required to be arranged.
