The invention discloses a door and window locking device and a door and window. The door and window locking device comprises a base, a lever handle and a shifting fork, wherein the base extends in thefront-back direction, the lever handle also extends in the front-back direction, and the lever handle is connected with the base through two swing arms; one ends of the swing arms are hinged to the base, the other ends of the swing arms are hinged to the lever handle, and the two swing arms are parallel to each other; and the shifting fork comprises a mounting part, and the two ends of the mounting part are hinged to the middle parts of the two swing arms correspondingly. According to the door and window locking device and the door and window, the base, the lever handle and the shifting forkare connected through the two mutually-parallel swing arms, and when a user forcibly shifts the lever handle, the lever handle and the shifting fork do overturning translational motion, so that driving action of the shifting fork is realized under the condition that the moving distance of the lever handle in space is short, and then locking operation of the door and window is realized.
