Implementation of the Revised Civil Penalties Resulting from Violations of Federal Motor Carrier Safety Regulations
In general, the findings from this study support the conclusion that FMCSA is implementing the revised civil penalties and carriers are responding positively. FMCSA is assessing higher civil penalties per enforcement case. These increases are in large part due to FMCSA assessing higher non-recordkeeping civil penalties. Preliminary data suggest that fewer carriers are repeating their violations and a higher percentage of carriers are paying their civil penalties on time. A summary of the factors influencing the results and the conclusions for each of the revised civil penalties is presented in this document.
