Geotechnical Engineering Notebook, Geotechnical Guideline No. 15: Differing Site Conditions
The purpose of this document is to provide guidelines on the practical application of a Differing Site Condition (DSC) contract clause, as related to subsurface conditions, and to address the variable nature of soil and rock materials when used as a foundation or construction material. This guideline should be of benefit to Geotechnical, Design and Construction personnel. Recommendations are provided on disclosure and presentation of subsurface information to bidders. The objective of these recommendations is, in part, to decrease bidding contingencies on subsurface items, address unexpected subsurface problems early, and provide a basis for equitable resolution of contractor claims based on differing subsurface conditions. Without a DSC clause, the risk of subsurface conditions is borne by the contractors who in turn must increase the price bid to mitigate the risk.
