Activists Use Courts to Force EPA Rulemaking
On January 26, the U.S. Court of Appeals granted an expedited rulemaking schedule negotiated between the Environmental Protection Agency (EPA) and environmental groups. The Idaho Conservation League (ICL) and five other environmental activist organizations filed a petition seeking to compel the EPA to promulgate financial assurance regulations required by section 108(b) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).
