Bottled‐Water System Exempt From Regulations
The water system operated by Crystal Springs Water Company consisted of three source wells with sediment filters, ultraviolet disinfection units, and charcoal filters. The company supplied drinking water to the public through four coin‐operated dispensing machines, to which purchasers brought their own containers. In February 1990, Pennsylvania's Department of Environmental Resources (DER), after two prior notices of violation, issued a compliance order finding that Crystal Springs was a “bottled water system” under the state Safe Drinking Water Act and that it was subject to the act's regulations. Specifically, the DER found that Crystal Springs failed to perform weekly microbiological monitoring at the source wells and the point of delivery. Crystal Springs asserted it was not subject to the regulations. The Environmental Hearing Board ruled in favor of Crystal Springs.
