Court Assigns Burden of Proof in Rate Case
In April 1990, Waymart (PA) Water Company filed a proposal with the public utility commission (PUC) for a 59 percent increase in operating revenue. It notified customers of its action. The proposed increase would raise the typical residential bill by 83 percent. John Schellhammer, a customer, asked the PUC about protesting the increase, and they sent him material including a formal complaint form. Schellhammer did not file a formal complaint, but he sent a letter of objection and a petition to the Bureau of Consumer Services. After an investigation and a meeting, the PUC directed Waymart to file for a smaller increase. Waymart complied, and PUC set a proposed effective date of July 10, 1990. Schellhammer learned of the new increase and filed a formal complaint and a request for reversal of the increase. An administrative law judge determined the rates were unjust and unreasonable and directed a decrease and refund.
