Statutory undertakers are often involved in construction operations. They can occasionally be a source of frustration when part of the Works is delayed because the statutory undertaker concerned has not turned up on site to make a connection to the main service. It is important to understand that when they are performing their statutory obligations they cannot be liable for breach of contract because they will not have a contract with either employer or contractor. If employers or contractors contract with statutory undertakers, they can include clauses in the contracts to deal with delays. This can be contrasted with the undertakers using their statutory powers to carry statutory obligations which may disrupt the contractor and cause delay but for which they cannot be held liable. It is important to determine in which capacity the statutory undertakers are carrying out work.
