The Employer's Requirements are the employer’s instructions to the contractor. It should specify the criteria, in contrast to the traditional prescriptive specification which specifies the particular way in which criteria are to be satisfied. If the Employer's Requirements are very brief and any drawings are very simple sketch plans, the employer will have little control over the end product. Most design and build contracts allow the employer to instruct variations, often referred to as ‘changes’ in this kind of contract. Usually, the only variations or changes that may be made are changes to the Employer's Requirements. The employer should obtain planning and any other necessary permissions before any tender is accepted. Of course, it is possible to make the contractor responsible for obtaining planning permission, but getting permission can never be guaranteed because it depends upon the planning authority.
