DNR Order Constituted Unlawful Taking of Property
An appellate court reversed an earlier court decision requiring a lake‐front property owner to excavate and maintain an artificial outlet ditch, which was originally constructed on his property in the early 1900's. The court found that the Wisconsin Department of Natural Resources request to have the property owner maintain the ditch was an unconstitutional taking of property.
