Shareholder Can't Change Diversion Point
East Jordan Irrigation Company owned water rights in Utah Lake and the Jordan River. Water was diverted from the river and lake into a canal and delivered to its 650 shareholders. Payson City Corporation bought 38.5 shares of Jordan's stock in 1987. Soon after, Payson filed an application with the state engineer to change the diversion point to a city‐owned well that draws water from a basin flowing into Utah Lake. Payson sought to use this water for year‐round municipal purposes. East Jordan and others protested the proposed change. However, the state engineer ordered that Payson be allowed to divert 144 acre‐ft between April 15 and October 31 and 38 acre‐ft the rest of the year. East Jordan brought this suit seeking to overturn the engineer's decision. The trial court ruled against East Jordan.
