Milton and Beatrice Barnes reside 0.25 mi downstream from a proposed earthen‐fill berm. The diversion of surface water drainage from the development would increase stream flow by about 8 percent. Because of this increased flow the Barneses complained that the stream would not dry up from time to time as it once had and would, therefore, result in proliferation of mosquitoes and flies in their yard. The trial court ruled against the Barneses and the appellate court upheld the decision.
