Landowner's Interest in Groundwater is Limited
Gerald and Nellie Smith own a home in Franklin Township, County of Summit, Ohio. During 1994, the county started construction on a road in front of the Smiths' house. The Smiths alleged that the construction deprived them of groundwater flow to a pond on their property. Apparently, the groundwater that fed the pond was either diverted or destroyed by the county's work. The Smiths brought suit, requesting the court to compel the county to begin eminent domain proceedings for the deprivation of the groundwater flow.
