Advance Notice Not Needed for Surcharge Tariff
The Providence (Rhode Island) Water Supply Board (PWSB) had encountered revenue shortfall generated by meter sales and also by undercollection of customer‐service charges in 1989, 1990, and 1991. This resulted in PWSB collecting less money than authorized by the Public Utility commission (PUC) pursuant to the rate filings considered by the PUC. PWSB filed a surcharge tariff to reimburse Providence for about $5 million in advances it made to the PWSB. The surcharge was assessed on all retail and wholesale customers of PWSB at the rate of $0.08/100 cu ft of water billed commencing Sept. 1, 1991. The state attorney general sought to have the tariff rejected. The PUC ruled for PWSB, and the state supreme court allowed the decision to stand.
