‘Practical completion’ is a term used in certain building contracts. Many architects believe that practical completion cannot be issued unless the Building Control officer has issued a certificate of completion. Although buildings must comply with the Building Regulations, the architect cannot delay the issue of a certificate of practical completion until a Building Control completion certificate has been issued unless the contract expressly says so. Many people confuse partial possession with sectional completion. Where section completion applies, the project is divided into sections and each section has its own dates for possession and completion, and its own amount of liquidated damages. Some architects and quantity surveyors think it is enough to put a list of so‐called ‘phase’ dates in the specification or bills of quantities to ensure that the contractor completes the various phases by the dates stated.
