Municipality Not legally Required to Provide Water
This case involved tenants who had applied for water service to their leased premises and had tendered the required deposit. The city water department denied the application based on a city ordinance that required the property owner to sign the tenant's application for water and to agree to be ultimately responsible for payment for all water provided. When the landlord refused to sign, the tenant sued to compel the city to provide water service. The trial court ruled against the tenants, and the tenants appealed the ruling. The Supreme Court of Utah upheld the constitutionality of the ordinance, stating that the city was authorized to operate a water utility but that it did not have a legal duty to provide water service to all members of the public.
