Water District Negligent in Death of Oak Tree
Frankie and Brenda Moon had a 22‐year old post oak tree on their residential property. Water started to fill a low area around the tree and eventually spread to an adjoining road and pasture. The Moons reported the leak to the White River Rural Water District. The district denied the leak came from its main. Later, it was discovered that the leak did indeed come from the water main. The district repaired the line, but the oak tree died. The Moons sued the district and recovered a $9,000 jury verdict for the loss of the tree. On appeal, the trial court decision was affirmed, but the amount was reduced.
