Validity of User Fees Upheld
The Barton Springs‐Edwards Aquifer Conservation District was an underground water district organized pursuant to Texas law. Under the district's rules, charges were imposed on water withdrawn through any nonexempt well (i.e., those with a production capacity in excess of 10,000 gpd) for which a permit was required. The charges were referred to as user fees. The law creating the district allowed such charges, provided they were reasonable. The Creedmoor Maha Water Supply Corp, and Cimarron Park Water Co. obtained water from wells that were subject to the charges. The companies sold, transported, and distributed the water through their facilities to customers within and adjacent to the district. The companies charged that the district's fees amounted to taxation and were imposed in violation of the law. The trial court, however, ruled in favor of the district.
