Standard building contracts refer to instructions and whether they must be in writing or oral, how they may be confirmed and by whom. But strangely they rarely define an instruction. Perhaps they assume that everyone knows what is meant by the word ‘instruction’ and that is probably a reasonable assumption. Having said that, it is important that everyone does know what an instruction is because the contractor has to comply with instructions from the architect. An instruction on a printed Architect's Instruction form is valid if authorised by the architect. Although all the standard forms of contract permit the architect to issue instructions under various circumstances, there is still a great deal of confusion. The architect's terms of engagement may well limit the issue of instructions and require the architect to seek authorisation before issuing any instruction which involves the expenditure of additional money.
